Terms of Service
By commissioning me, you agree to all the Terms of Service stated below. If you have any questions, please email me at [email protected]✧ ToS applies to all services, I, the Artist, provide ✧Violating these terms will terminate the transaction between client and artist, will take away any right the client had over the work and will also put you on a blacklist. Please fully read these terms!!!
If you are not comfortable with my T.O.S and/or are not willing to agree to the conditions, you may not request a commission.TYPES OF COMMISSIONS
Personal use (post on social medias, printing for personal use): illustration.
Commercial use: illustration, character/VTuber model design, VTuber model art, VTuber model rig, some types of 2D animations(gifs, wallpapers, etc).COPYRIGHT & USAGE POLICYARTIST
The artist holds the rights to the produced drawing, not the commissioner. Therefore the following is within the artist’s rights:
• Decline any project or client for any reason
• For personal use illustration commissions: sign and/or watermark the artwork. I will send you a full resolution image (by email or via google docs), but my signature will remain on both the full resolution and smaller versions of the artwork
• Present the artwork as sample or portfolio piece to other individuals or groups, promote their self with the art piece on any platform, record and livestream the progress of commissions (Unless piece is PRIVATE or is not a debuted VTuber model). I will give proper credit to you for ownership of the character’s design if you want to unless it was one of my own designs. I can specify your name as the customer if you want to
PRIVATE - option for illustration and character design commissions. You will need to pay fee for this option and I will not post your commission on any platform at all.CLIENT
Any client who has ordered from me must give proper credit to me in places where my artwork is published
(For VTubers, please credit artist’s name in the bio)
Any client who has ordered from me is not allowed to:
• Taking credit for the creation of the artwork itself
• Change, modify, edit my works without my permission (I’m usually open to adjustments, just let me know)The client who ordered illustration for personal use is not allowed to:
• Use artwork as goods to sell commercially
• Reproducing the artwork commercially and/or selling the artwork, publicly or privately (making money out of it, in any way)
• Removing or altering any watermarks/signatures without the consent and knowledge of the artistYou may purchase commercial rights for illustration commission (1.5-2x of the original rate but price will vary. If you want a commercial license please let me know right away).- Client can request for their piece to be posted publicly (if I post your commission, I will sign that you are the customer), posted as secret commission (if I post your commission, I will not sign who the customer is), or kept PRIVATE* (I will not post your commission, you will need to pay fee for this option).COMMISSIONS ORDERING• To guarantee total accuracy to your commission request, please make note of the required details and elements in the form.
• If your character is extremely detailed, I have the right to charge a fee to include these details. This fee will be stated before the transaction, and you hold the right to make changes to your commission request (eg. change the character, agree to simplified design changes) before the transaction is complete.
• Please make your request concisely worded with minimal abbreviations, so as to make the note clear to read.┃Process┃Time of completion differs from comm to comm (it can be anywhere between 1 week to 3 month). I'll let you know beforehand and will update you on the status of your commission. Time is also effected by circumstances of the artist (health or family issues) which the Client will be notified of if issue arises. I can issue a refund for work that was not done if something serious happens to me and I have to stop working.
┃Deadlines┃Deadlines MIGHT be negotiable ahead of time (and in special cases might possibly increase comm price). Otherwise, there is no absolute deadline and or date that the client will acquire their piece.PAYMENTPayment through PayPal invoices or SWIFT.
• Please note that all of my sales are "Digital Artwork" and it is the Artwork’s "Intellectual Property" that is purchased by you, the Client.
• Nothing is ever intended by either me or the Client, to be physically shipped.
• I am not required ever to ship any item.You will pay a minimum of 50% before I start working on your commission. For commission that cost ≤ 35$ you will pay 100%Illustrations:
I will send you a sketch and you can ask me for some changes. After your confirmation of the sketch, you must send the rest of the amount, and then I will continue working on your commission.
VTuber model/character design:
I will send you a sketch and you can ask me for some big changes and clarify some aspects that you want in your character. After your confirmation of the sketch, you must send the rest of the amount, and then I will continue working on your commission.
VTuber model art:
I will send you a lineart or lineart+flat colors of all separated pieces and you can ask me for some changes in separation and clarify some aspects that you want in your character. After your confirmation, you must send the rest of the amount, and then I will continue working on your commission.
VTuber model rig:
I will send you video of a head rig and you can ask me for some changes. After your confirmation, you must send the rest of the amount, and then I will continue working on your commission.✧ The prices in the following pages are only meant as guidelines. I will give you a final price after assessing your references and requests ✧
• I will only accept USD as payment. You are responsible for making currency conversions.REFUNDS/CHARGEBACKS
• No refunds allowed from the moment I started working on your commission.
• You are NOT authorized to issue a chargeback for any reason.
• I can issue a refund for work that was not done if something serious happens to me and I have to stop working.
• If for any reason your PayPal account malfunctions or authorizes a refund request without your knowledge, you must contact me as soon as possible in order to resolve the issue.
• Purposefully issuing a chargeback will result in immediate blacklisting for you as well as your email address, and anyone sharing your PayPal account, including side accounts.WORKS IN PROGRESS AND FEEDBACK
• I will sometimes send you a works in progress picture until your commission is completed.
• These images will come in the form of .jpg or .png files as an attachment in the email.
• Please be available to provide feedback during this time.
• I am not responsible for any unsatisfactory element of the finished design if no feedback was given to amend it.ORDER CHANGES / MODIFICATIONS
For illustration commissions:
• I will only do changes in the sketch phase. Any color corrections can be done at the color stage.
• Small changes are allowed after the commission is finished, such as color adjustments or if a missing or inaccurate element was an error on my part (ie. I missed a detail that you had provided in the order).
• If initial feedback was not provided clearly, any changes to the final piece will come with a fee.FINAL PRODUCT
• There may be slight differences between the samples in my gallery and the illustration you will receive.
• Credit to me, the Artist, is required when you post or use it on another platform.
• You, the Client, are responsible for saving any information, images, and other digital data I provide.
• Any file you paid for will be available from me for a finite time only. I take measures to preserve most files for up to 4 months. However, I cannot guarantee against computer failure or accidental deletion or loss.
• I am not required to post your project in any public space, and if posted, I am not required to keep it there indefinitely. I have the right to delete or remove project. You should have your own copy.
• Any comments about final product that are rude, inappropriate, inflammatory, and/or non-constructive may result in blacklisting.Violating ToS will put you on a blacklist, and I will have the right to talk about you as an unscrupulous customer in my socials.
